Most violations of the Fair Labor Standards Act do not occur because an employer is underpaying someone. It may be that the company has not structured their payments properly.  For example, in a recent case, 300 employees collected $4,000,000 from their employer because their pay was not structured properly.  They regularly earned $80,000 to $90,000 per year so the violation was not because they were paid sub minimum wage.  A one paragraph agreement signed at the time of hire could have saved the employer $4,000,000.

Most compliance reviews do not take much time and do not involve large numbers of employees other than those in top management.  This keeps business interruptions at a minimum during the review.

There are methods of keeping compliance review information confidential so that it can not be used against the company at a later date.

Plaintiff's attorneys are becoming more and more aggressive.  The amount they collect in back wages from businesses and local governments rises every year.

DOL back wage collections are rising each and every year. 

Insurance may not cover litigation losses of this type.
