The National Labor Relations Board confirms the Acting Regional Director’s decision that client/consumer workers with disabilities paid special commensurate wages under a Fair Labor Standards Act Section 14(c) Special Minimum Wage Certificate on a federal janitorial contract are “employees” under the National Labor Relations Act, NLRA. The workers were working on a Service Contract Act, SCA, contract under the JWOD Act. Under the NLRA, the workers have all the rights as other employees including but not limited to concerted activity protection, the right to petition for an election to determine if the workers want representation by a union, the right to organize, the right to join a union and the right to have representation during an “investigative interview” that may result in disciplinary action. The decision references similar cases with client/consumer workers. (See the discussion of the implications of the decision on the last page.)

FLSA Section 13(b)(1): Congress amended the Motor Carrier Act, MCA, and changed the
definition of commercial motor vehicle resulting in the loss of the overtime exemption to
thousands of drivers, loaders, and mechanics of light vehicles with a GVW of less than
10,001 pounds. Generally, all drivers of light vehicles must be paid overtime pay after 40
hours per week unless exempt under another provision of the FLSA. This document provides
the explanation and the text of the USDOL Field Service Bulletin announcing the
enforcement change.
