Emergency Paid Sick Time
We have prepared a handout guide, updated August 3, 2020, to the Emergency Paid Sick Leave Act that requires paid sick leave for employees who cannot work or telework due to six listed causes related to the COVID-19 pandemic. This is not the same as the Expanded FMLA paid and unpaid leave.
Some points worth noting:
- Virtually all private employers, for-profit, not-for-profit, with less than 500 employees and all public agencies must comply. There are NO statutory exemptions for small employers. There is a partial exemption from only one absence cause (#5) for employers with less than 50 employees.
- ALL employees are eligible IMMEDIATELY on April 1, 2020, regardless of time employed and without a waiting or qualification period REGARDLESS of the employer’s leave policies.
