Effective April 1, 2020
We have prepared two handouts to the FFCRA, one for the Emergency Paid Sick Leave Act and one for the E-FMLA Expanded Leave Act related to the COVID-19 pandemic.
Some points worth noting:
- Virtually all private employers, for-profit, not-for-profit, with less than 500 employees and all public agencies must comply. There are NO statutory exemptions for small employers. There is a partial exemption from only one absence cause (#5) for employers with less than 50 employees.
- ALL employees are eligible IMMEDIATELY on April 1, 2020, regardless of time employed and without a waiting or qualification period REGARDLESS of the employer’s leave policies.
