FFCRA and Paid Sick Leave and the E-FMLA Expanded FMLA Leave

Emergency Paid Sick Time

Emergency Family and Medical Leave Expansion Act

Effective April 1, 2020

We have prepared two handouts to the FFCRA, one for the Emergency Paid Sick Leave Act and one for the E-FMLA Expanded Leave Act related to the COVID-19 pandemic.

                Some points worth noting:

  1. Virtually all private employers, for-profit, not-for-profit, with less than 500 employees and all public agencies must comply. There are NO statutory exemptions for small employers. There is a partial exemption from only one absence cause (#5) for employers with less than 50 employees.
  2. ALL employees are eligible IMMEDIATELY on April 1, 2020, regardless of time employed and without a waiting or qualification period REGARDLESS of the employer’s leave policies.

If you have questions, please post them on our Facebook page or email them to

We will be placing additional guides and handouts in the Downloads section (click above at the header) and in the Families First Coronavirus Response Act section.
